The Supreme Court Judgment: immediate reactions

On 16 April 2025, the Supreme Court of the United Kingdom issued their landmark judgment on the case For Women Scotland brought against the Scottish Government. You can read the whole judgment on the Court’s website.

Many people are making sweeping claims about the interpretation of the judgment, which determines that, in the Equality Act 2010, the words ‘woman’ and ‘sex’ refer to biological sex. It also makes clear that ‘sexual orientation’ relies on that biological understanding. It is not the piece of paper that a gay man fancies: it’s your whole, male body. And, of course, the binary opposite for lesbians.

We have taken some steps already:

  • we have issued a statement (see below) which we will be following up with the press;
  • we have written to the First Minister (also below) requesting a meeting and that the whole misshapen Action Plan be withdrawn;
  • we unreservedly condemn the fear mongering, hateful language and vandalism associated with the public protests of the weekend after the judgment;
  • we will be suggesting steps for your action in the next few days; and
  • with many thanks to FiLiA, we will be updating the legal advice and our lay-persons guide to the Legal Defence of Lesbian Space in the next few days.

We also thank Scottish Lesbians, The Lesbian Project, LGBA UK and Sex Matters for their interventions in this case, which obviously helped their Lordships understand the position of lesbians as a result of the push of gender ideology.
